Namibia starts legal drafting of PPP Law

Ms. Ericah B. Shafudah, who serves as a Permanent Secretary in the Ministry of Finance of Namibia, stated that the legal drafting of the public private partnership (PPP) bill is expected to be finished in the next two to three months.

This announcement comes after the submission of the draft PPP bill to the Attorney General. According to sources, Ms. Ericah commented:

"The Ministry of Finance has prepared a draft of the PPP Bill after extensive external and internal consultations and reviews. The Draft PPP Bill has received approval in principle from the Cabinet, and the Draft was approved by the Cabinet Committee on Legislation (CCL). The Draft PPP Bill, after incorporating comments of the CCL, was submitted by the Ministry of Finance to the office of the Chief Legal Drafter in March 2016. We hope that the process of legal drafting is completed over the next two to three months. This shall be followed by submission of the Draft Bill to the office of the Attorney General."

The country's PPP Law was published in September 2015 and it is currently in the process of finalization.

She added that while a Public Private Partnership policy was already in place, the act would build upon the policy.

Namibia already has a comprehensive PPP Policy, which not only includes the development of a PPP law but also the establishment of a PPP Committee and PPP Unit under the Ministry of Finance empowered with the capacity and knowledge to determine whether PPP is the most appropriate procurement option and, if this is determined to be the case, to assist the authorities to transact the project.
