Nigerian airport concessionaire upholds validity of contract amidst dispute with Federal Airport Authority

Bi-Courtney Aviation Services Limited has released a statement confirming the validity of its concession to operate the domestic terminal at Murtala Muhammed Airport (MMA2), located in Ikeja, south-west Nigeria.

This follows reports that the company's concession, signed with the Federal Airport Authority of Nigeria (FAAN) in February 2007, is due to expire and, accordingly, the government has commenced plans to terminate the contract and transfer ownership of the terminal to FAAN.

Bi-Courtney has stated in response that "the clear provisions of the concession agreement between Bi-Courtney and the Government uphold the operation of the MMA2 terminal for an undisputed period of 36 years", indicating that the concession will expire in 2043.

The statement also upholds Bi-Courtney's accusation that FAAN has consistently breached its obligations in the concession agreement in not handing over the General Aviation Terminal (GAT), commissioned in 2012, and has caused Bi-Courtney to lose over NGN250 billion (US$688.7 million).

FAAN insists that the GAT does not breach the concession contract. The two parties are engaged in a formal dispute process regulated by the Federal Government's Infrastructure Concession Regulatory Commission (ICRC).
