The Birmingham Court of Appeal has ruled that Amey has been deliberately leaving the defects in selected areas of the area covered by the PPP contract untreated and has been carrying out works based on inaccurate inventory information. The concessionaire had been refusing to update the Project Network Model, which contained contractual inventory data on the network under its care. The Court of Appeal reinstated judgements from a previous independent adjudicator in the case, whose decision was overturned by a High Court Judgement in 2016 following an appeal by Amey
