Preliminary injunction interferes implementation of Major Bridges PPP program in Pennsylvania

A Commonwealth Court judge issued the preliminary injunction on May 18, regarding the proposed replacement of Interstate-83/South Bridge in Harrisburg, Pennsylvania, USA.

The bridge is part of the Major bridges PPP program proposed by the Pennsylvania Department of Transportation. This preliminary injunction stops the public authority from advancing a plan to upgrade nine bridges using public-private partnerships. The program includes the establishment of tolls on these bridges to pay for their replacement by a private partner under the Design-Build-Operate-Maintain PPP delivery model.

In the ruling, the judge mentioned that the Public-Private Transportation Partnership Board approval of the concept of tolling is lacking sufficient specificity and does not provide enough details. As a result, the board was unable to meet its other requirement of consulting with the relevant municipalities prior to concept approval.
