AFAB Awards PPP Contract for Freeport Area of Bataan Water and Sanitation Project

The Improvement and Management of the Water Supply and Sanitation Services of the Freeport Area of Bataan (FAB) Project has been formally awarded by the Authority of the Freeport Area of Bataan (AFAB) to the original proponent consortium composed of Tubig Pilipinas Group, Inc. (TPGI) and FB Infrastructure Corporation (FBIC) through a Notice of Award dated 1 July 2026. The award follows the recommendation of AFAB's Public-Private Partnership (PPP) Pre-Qualification, Bids and Awards Committee under Resolution No. 01 dated 29 June 2026. The project has an estimated total cost of PHP1.358 billion (US$22 million) and will be implemented through a Joint Venture Agreement (JVA).

The project aims to improve the delivery of water supply and sanitation services within the Freeport Area of Bataan by rehabilitating, modernizing, operating, maintaining, and expanding the existing water and wastewater infrastructure. Through the PPP arrangement, the private sector partner will invest in upgrading water production and distribution facilities, replacing aging pipelines, enhancing wastewater collection and treatment systems, and deploying modern metering and monitoring technologies. These improvements are intended to provide reliable, efficient, and sustainable water and sanitation services that will support the Freeport's growing industrial, commercial, and residential communities.

As part of the award conditions, the consortium is required to fulfill several requirements within 20 calendar days from receipt of the Notice of Award. These include posting a performance security worth PHP135.814 million (US$2.2 million)(equivalent to 10% of the total project cost), providing proof of an equity contribution amounting to PHP271.628 million (US$4.4 million), securing financing commitments from reputable financial institutions, submitting board resolutions authorizing the execution of the Joint Venture Agreement, certifying that all representations and warranties remain valid, and submitting a finalized and notarized consortium agreement consistent with the evaluated ownership structure. Failure to comply with these requirements within the prescribed period may result in the automatic cancellation of the award and the forfeiture of the bid security in accordance with the Implementing Rules and Regulations of the PPP Code. Upon verification that all conditions have been satisfied, AFAB will notify the consortium, after which both parties are required to execute the Joint Venture Agreement within five calendar days. The consortium must also formally signify its acceptance of the Notice of Award by signing and returning the "Conforme" portion within three calendar days of receipt.
